Terms of Use

Welcome to porsyo.com. These Terms of Use (“Terms”) govern your access to and use of the Porsyo AI-powered nutrition tracking platform (the “Service”), including the Porsyo mobile application available on the Apple App Store and Google Play. By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Introduction

These Terms form a legally binding agreement between you and Evrim Olçum - Kodado, a sole proprietorship established under the laws of the Republic of Türkiye (“Porsyo,” “we,” “us,” or “our”), the provider of the Service.

2. Eligibility

You must be at least 13 years old to use the Service. If you are under the age of majority in your country of residence, you may only use the Service with the involvement of a parent or legal guardian. By using the Service, you represent that you meet these eligibility requirements.

3. Use of the Service

(a) The Service provides AI-powered nutrition tracking, including food photo analysis, nutritional calculations, personalized recommendations, and an AI nutrition coach you can interact with via chat.
(b) You agree to use the Service only for lawful purposes and in compliance with all applicable laws and regulations.
(c) You are responsible for maintaining the security of your account credentials and any associated data.
(d) You represent and warrant that your use of the Service will comply with all applicable laws at all times.
(e) Restrictions. You must not, and must not enable or allow any other party to:
- use the Service for any illegal or unauthorized purpose;
- attempt to gain unauthorized access to any portion of the Service;
- reverse engineer, decompile, or disassemble any portion of the Service;
- use the Service to share inappropriate or harmful content;
- use the Service in a manner that could damage, disable, overburden, or impair the Service.

4. User Responsibilities

(a) You are responsible for maintaining the confidentiality of your account information.
(b) You must provide accurate and complete information when creating your account.
(c) You are responsible for all activities that occur under your account.

5. Subscriptions, Auto-Renewal and Payments (Apple App Store)

Some features of the Service (“Porsyo Premium”) require a paid auto-renewable subscription. Subscription options offered through the Apple App Store include:

Porsyo Premium Weekly — billed weekly
Porsyo Premium 3 Months — billed every 3 months
Porsyo Premium Annual — billed yearly

Current pricing in your local currency is displayed on the in-app paywall screen prior to purchase, and is set in accordance with Apple’s pricing tiers.

Auto-Renewable Subscription Terms:

Payment. Payment will be charged to your Apple ID account at the confirmation of purchase.
Automatic Renewal. Subscriptions automatically renew at the end of each billing period at the price you originally selected, unless auto-renew is turned off at least 24 hours before the end of the current period.
Renewal Charge. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period.
Managing Subscriptions. You can manage your subscription and turn off auto-renewal at any time by going to your Account Settings on the Apple App Store after purchase (Settings → [your name] → Subscriptions).
Free Trial. If a free trial period is offered, any unused portion of the free trial will be forfeited when you purchase a subscription, where applicable.
Refunds. Refund requests are handled by Apple in accordance with the Apple Media Services Terms and Conditions. All fees are non-refundable except as required by law or as expressly granted by Apple.
Price Changes. We reserve the right to change subscription fees. You will be notified of any price change at least 30 days in advance and will be given the opportunity to accept the new price before being charged.

6. Apple-Specific Terms (Licensed Application End User License Agreement)

By using the Service via the Apple App Store, you also agree to Apple’s standard Licensed Application End User License Agreement (“Apple Standard EULA”), available at: https://www.apple.com/legal/internet-services/itunes/dev/stdeula/

The Apple Standard EULA, together with these Terms, governs your license to use the Porsyo mobile application on Apple-branded products. In the event of a conflict between the Apple Standard EULA and these Terms, these Terms shall prevail to the extent permitted by the Apple Standard EULA.

You acknowledge and agree that:

(a) Apple has no obligation to furnish any maintenance or support services with respect to the Porsyo application;
(b) Apple is not responsible for product warranties, whether express or implied by law;
(c) Apple is not responsible for addressing any claims by you or any third party relating to the Porsyo application, including product liability claims, claims that the application fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection or similar legislation;
(d) Apple is not responsible for the investigation, defense, settlement or discharge of any third-party claim that the Porsyo application infringes that third party’s intellectual property rights;
(e) Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.

7. Prohibited Activities

You may not use the Service for any of the following:

(a) Sending or receiving illegal or harmful content;
(b) Engaging in fraudulent or deceptive activities;
(c) Violating any third-party rights or intellectual property laws;
(d) Using the Service to harass, abuse, or harm others.

8. Data Privacy & Security

(a) We collect and process personal data in accordance with our Privacy Policy: https://porsyo.com/privacy-policy.
(b) You are responsible for ensuring your nutrition and food data is protected in compliance with applicable data protection laws.
(c) We implement industry-standard security measures to protect your data.

9. AI Features and Limitations

(a) The Service uses AI to analyze and identify food items in your photos, to generate nutritional recommendations, and to power an AI nutrition coach that interacts with you via chat.
(b) The AI nutrition coach is powered by third-party large language model (LLM) providers. Your health and nutrition data, including dietary preferences, allergies, medical restrictions, and chat conversations, may be sent to these providers to generate personalized responses. Your data is not used by these providers to train their AI models, and all providers we use are bound by data processing agreements.
(c) AI-generated nutritional analysis and coaching responses may not always be accurate or complete.
(d) You are responsible for reviewing and verifying AI-generated information before relying on it, particularly for medical, allergy, or dietary-restriction purposes.
(e) The Service, including the AI nutrition coach, is not a substitute for professional medical, nutritional, or dietary advice. Do not use the Service to diagnose, treat, or prevent any medical condition. Always consult a qualified healthcare professional regarding any medical or health concerns.
(f) We do not guarantee the accuracy, completeness, or reliability of any AI-generated content.

10. Service Availability

(a) We strive to maintain 24/7 availability of the Service.
(b) We may perform maintenance or updates that temporarily affect Service availability.
(c) We are not liable for any damages resulting from Service unavailability.

11. Intellectual Property

(a) All content and materials available through the Service are protected by intellectual property rights.
(b) You may not copy, modify, or distribute any content from the Service without our permission.
(c) You retain ownership of your food photos, nutritional data, health information, and chat conversations with the AI coach. You grant us a non-exclusive, worldwide, royalty-free license to process this data through the Service (including via third-party AI providers) for the sole purpose of providing the Service to you. We do not sell your data or use it to train AI models.

12. Termination

(a) We may terminate or suspend your access to the Service for violations of these Terms.
(b) You may terminate your account at any time by following the account closure process in the application Settings.
(c) Upon termination, we will delete or anonymize your data in accordance with our Privacy Policy.
(d) Termination of your subscription does not entitle you to a refund of any portion of pre-paid subscription fees, except as required by applicable law.

13. Changes to the Terms

(a) We may update these Terms from time to time.
(b) We will notify you of significant changes via email or through the Service.
(c) Continued use of the Service after changes constitutes acceptance of the revised Terms.

14. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE ERROR-FREE OR UNINTERRUPTED.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, LOSS OF DATA, BUSINESS INTERRUPTION, OR ANY OTHER COMMERCIAL DAMAGES OR LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE. IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES (OTHER THAN AS MAY BE REQUIRED BY APPLICABLE LAW IN CASES INVOLVING PERSONAL INJURY) EXCEED FIFTY U.S. DOLLARS ($50.00).

16. Export Compliance

You may not use or otherwise export or re-export the Service except as authorized by applicable laws of the Republic of Türkiye and the laws of the jurisdiction in which the Service was obtained. The Service may not be exported or re-exported to any country, person, or entity subject to applicable Turkish, United Nations, European Union, or other international sanctions or export-control restrictions.

17. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Republic of Türkiye, without regard to its conflict of laws principles. Any dispute, controversy, or claim arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the Çağlayan (Istanbul) Courts and Enforcement Offices (&Idot;stanbul Mahkemeleri ve &Idot;cra Daireleri).

If you are a consumer residing in Türkiye, nothing in these Terms shall limit your mandatory rights under the Turkish Law on the Protection of the Consumer (Law No. 6502) and related legislation. Consumer disputes within the monetary thresholds set by the Ministry of Trade may be brought before the competent Consumer Arbitration Committees (Tüketici Hakem Heyetleri) or Consumer Courts (Tüketici Mahkemeleri) in your place of residence. If you are a consumer residing in another country, you also retain the benefit of any mandatory consumer protections available under the laws of your country of residence.
